At Moksha Wellness LLC d/b/a Zen with Katie ("Zen with Katie," "Moksha Wellness," "we," "us," or "our"), we value your trust and are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your information when you purchase, book, access, attend, or otherwise interact with our Wellness Services and when you interact with us online or in person.

This Privacy Policy should be read together with our Terms and Conditions, liability waiver, Social Media Disclaimer, booking policies, invoices, and any other agreements or notices we provide in connection with the Wellness Services. In the event of a conflict, those additional terms may govern more specific issues relating to the applicable Wellness Service.

1. Who We Are 

Moksha Wellness LLC d/b/a Zen with Katie is a woman-owned business based in Colorado. Zen with Katie offers in-person and online wellness offerings, including Kriya yoga, other yoga offerings, breathwork, meditation, sound baths, workshops, retreats, private sessions, corporate offerings, event-based offerings, livestream services, recorded content, and related wellness experiences (collectively, the "Wellness Services"). 

3. How We Use Your Information 

We may use your information to:
  • provide, operate, maintain, and improve our Wellness Services;
  • schedule our Wellness Services;
  • process purchases, packages, bookings, invoices, and payments;
  • communicate with you or with a host, sponsor, organizer, or event contact about bookings, participant coordination, customer service requests, schedule changes, policies, venue details, and business updates;
  • send marketing emails, text messages, newsletters, promotions, and social-media-related communications, subject to your communication preferences and applicable law;
  • personalize your experience and recommend classes, events, products, or services that may interest you;
  • administer recorded content, virtual offerings, and related access controls;
  • use photos, videos, testimonials, and related content for community-building, promotional, archival, or marketing purposes, subject to any permissions, releases, or opt-out choices we may offer in particular circumstances;
  • monitor usage, analyze trends, troubleshoot issues, and improve the functionality, safety, and security of our website and systems;
  • detect, prevent, or address fraud, abuse, security incidents, or violations of our policies;
  • comply with legal obligations; and
  • enforce our Terms and Conditions, waivers, booking policies, studio policies, and other agreements. 

6. Data Security 

Zen with Katie takes reasonable administrative, technical, and physical safeguards to protect personal information in a manner commensurate with the size and scope of her business and the nature of the information collected. Appropriate safeguards may include, for example, using strong and unique passwords, enabling multi-factor or two-factor authentication where available, restricting access to personal information, using reputable third-party platforms, keeping software and devices updated, securing laptops and other devices, and taking reasonable steps to avoid unauthorized access, use, alteration, or disclosure.

However, no method of transmission over the internet, electronic storage, or other mode of data handling is 100% secure, and we cannot guarantee absolute security.

In the event of a suspected or confirmed data breach, we will act prudently and in accordance with applicable legal requirements, including Colorado data-security and breach-notification requirements where applicable. 

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the Wellness Services, maintain business and booking records, comply with legal, tax, accounting, and regulatory obligations, resolve disputes, enforce agreements, and protect our legitimate business interests.

As a general business practice, Zen with Katie expects to retain typical business records for approximately 3 to 6 years consistent with standard business practices, although some information may be retained for a shorter or longer period depending on the nature of the record, legal requirements, dispute considerations, tax or accounting needs, or operational necessity. When personal information is no longer needed, we will delete, de-identify, or securely dispose of it as appropriate.

8. Your Choices and Requests 

You may have the following choices, subject to applicable law:

  • Marketing Emails: You may unsubscribe from marketing emails by using the unsubscribe link in the message or by contacting us.
  • Marketing Text Messages: You may opt out of marketing text messages by replying as instructed in the message or by contacting us, subject to the terms of the applicable messaging program.
  • Access, Correction, and Deletion Requests: You may contact us to request access to, correction of, or deletion of certain personal information, subject to applicable law and our legal or operational retention needs.
  • Cookies and Similar Technologies: You may manage cookies through your browser settings and, where offered, through any cookie preference tools on our website. 

9. Colorado Privacy Rights 

Zen with Katie is a small wellness business and does not currently expect the Colorado Privacy Act to apply to its processing activities based on the nature and scale of the business as currently operated. If our data practices or legal obligations change, we may update this Privacy Policy accordingly. If you have a privacy-related question or request, you may contact us using the information in Section 17 below. 

10. Additional U.S. State Privacy Rights 

Residents of other U.S. states may have privacy rights under applicable state laws, including rights to access, correct, delete, or obtain a copy of personal information, as well as rights to opt out of certain types of processing such as targeted advertising, sale of personal data, or profiling in furtherance of certain decisions, where applicable. Because privacy laws vary by state and may change over time, we will evaluate and respond to verified requests in accordance with the law that applies to the particular request and our processing activities. 

11. Children, Teens, and Family Programming

Our website and Wellness Services are intended primarily for adults and are not intended for children under the age of 13. We do not knowingly collect personal information directly from children in a manner inconsistent with applicable law.

If we offer teen, family, or kids yoga classes, workshops, camps, or related programming, participation by minors requires parent or guardian registration, consent, waivers, and other permissions. In those circumstances, we may collect information from a parent or legal guardian, and we may collect limited information relating to the participating minor as reasonably necessary to provide the Wellness Services, maintain safety, and administer the program.

If you believe a child has provided personal information to us inappropriately, please contact us so we can review and take appropriate action. 

12. Links to Third-Party Sites and Services 

Our website or communications may contain links to third-party websites, apps, booking tools, payment services, social media platforms, or other services. We are not responsible for the privacy practices of those third parties, and their practices are governed by their own policies. 

13. International Users 

Zen with Katie is based in the United States. If you access our Wellness Services from outside the United States, your information may be transferred to, stored in, and processed in the United States and other countries where our service providers operate, which may have data protection laws different from those in your home jurisdiction.

We do not specifically market the Wellness Services outside the United States, but if laws outside the United States apply to our processing activities, we may take additional steps that we determine are appropriate under the circumstances. We may also update this Privacy Policy from time to time to reflect changes in our practices, service areas, or legal obligations. 

14. Communications and Social Media 

If you interact with us on social media, any content you submit, tag us in, message to us, or make publicly available may be visible to others, subject to the privacy settings and practices of the relevant platform. We may also repost, share, or respond to social media content that you make available to us or publicly associate with our Wellness Services, subject to any permissions we request or platform tools you use.

15. Governing Law and Venue 

This Privacy Policy, and any dispute arising out of or relating to this Privacy Policy or our handling of personal information, shall be governed by the laws of the State of Colorado, without regard to conflict of laws principles. The state and federal courts located in or serving Denver, Colorado, shall have exclusive jurisdiction and venue over any such dispute, and you consent to the personal jurisdiction of those courts. 

16. Changes to This Privacy Policy 

We may update this Privacy Policy from time to time. If we make changes, we will post the updated version with a revised Effective Date. Your continued use of the Wellness Services after an update becomes effective indicates your acceptance of the revised Privacy Policy, to the extent permitted by law. 

4. How We Share Your Information 

We do not sell your personal information for money. We may disclose personal information in the following circumstances:
  • Service Providers and Contractors: We may share information with vendors that help us operate our business and Wellness Services, such as website hosts, payment processors, analytics providers, email and text communication platforms, content hosting providers, customer relationship management providers, and scheduling or event-management software providers.
  • Hosts, Sponsors, Organizers, Guest Teachers, and Wellness Partners: From time to time, we may provide Wellness Services in collaboration with corporate clients, event sponsors, retreat operators, private hosts, venues, guest teachers, or wellness partners. If you register for or participate in a corporate event, private event, retreat, workshop, or similar offering, we may share limited information reasonably necessary to administer that offering, such as your name, contact details, attendance status, booking-related information, or participation logistics. We expect such recipients to use your information only as needed for the relevant offering unless you separately consent to additional uses.
  • Legal, Safety, and Compliance Purposes: We may disclose information when reasonably necessary to comply with law, regulation, legal process, court order, or lawful requests, or to protect the rights, safety, and property of Moksha Wellness, our clients, our staff, or others.
  • Business Transfers: We may transfer information in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to applicable confidentiality and legal requirements.
  • With Your Direction or Consent: We may share information when you direct us to do so or otherwise consent.
We do not share personal information with third parties for their own standalone direct marketing purposes unless you separately consent.

2. Information We Collect 

We collect information that is reasonably necessary to operate our Wellness Services, communicate with you, process transactions, coordinate bookings and events, improve our offerings, and support the client experience.

Personal information may come to us in two primary ways:
  • Directly from you: when you contact us, book or purchase Wellness Services, complete forms or waivers, communicate with us, participate in events, submit testimonials, or otherwise interact with us.
  • Through a host, sponsor, coordinator, or other organizer: when a corporate client, event sponsor, retreat organizer, host, venue contact, or other privately sponsored event organizer provides participant or attendee information to us so that we can coordinate, administer, invoice, prepare for, or deliver the applicable Wellness Services.

We may collect:
  • Contact Information: such as your name, email address, phone number, mailing address, emergency contact information, and similar identifiers.
  • Booking and Client Information: such as class or event registrations, attendance history, package information, preferences, responses to intake or waiver forms, invoice-related information, and customer support requests.
  • Transaction Information: such as purchase history, payment status, and limited payment-related details. Payments may be processed by third-party providers, and for most bookings, we do not store full payment card numbers.
  • Event and Sponsor Information: for corporate events, private events, retreats, hosted offerings, or other sponsored programs, information relating to the host organization, sponsor, event contact, participant roster, scheduling details, venue details, and related coordination information.
  • Communications: such as emails, text messages, direct messages, inquiries, survey responses, testimonials, and other communications you send to us or receive from us.
  • Technical and Usage Data: such as IP address, browser type, device information, approximate location derived from IP address, pages viewed, links clicked, referring pages, session activity, and similar website or platform usage information.
  • Media and User Content: such as photographs, video recordings, audio, livestream participation, chat submissions, comments, reviews, social media interactions, and your image, likeness, voice, or name or handle when captured or shared in connection with Wellness Services.
  • Information About Minors Provided by a Parent or Guardian: if we offer teen, family, or kids programming, we may collect information relating to a participating minor from the minor's parent or legal guardian as reasonably necessary to administer those Wellness Services.

We do not intentionally request or require medical records, physician referrals, or protected health information in the ordinary course of operating our wellness business. Please do not submit sensitive medical information unless we specifically request it for a lawful and necessary purpose. 

5. Cookies and Similar Technologies

We may use cookies, pixels, tags, SDKs, and similar technologies to operate our website, remember preferences, understand how users interact with our Wellness Services, improve website performance, and support analytics, communications, and marketing.

Depending on the tools we use, these technologies may be set by us or by third-party providers. You can manage cookies through your browser settings. If you disable certain cookies or similar technologies, some site features may not function properly.
